Of course, while such things are highlighted by media, the truth is that mistakes-and particularly in capital cases-are few and far between. Punishment is rarely designed as something for which mistakes are considered. Mistakes will happen from time to time, but that is not a reason to ignore justice. The death penalty makes sense because it creates a high standard of behavior. To not punish heinous crimes more severely than others-kidnapping and murdering children, molesting and killing, raping and torturing-is equated with negligence. Indeed, in a good society, there is a place for severe punishment, even when that punishment is death. Originally, capital punishment was brought to the American colonies from England and colonial legislation usually applied the death penalty to many crimes. The Black Act of 1723 authorized execution as the punishment for a wide range of transgressions, from cutting down young trees to writing threatening letters (Knoll, 1994). Of course, today, the death penalty for petty crimes would be immoral. It is now reserved for the most deadly crimes. The law for the death penalty goes by state, and each states usually signifies that special circumstances must be considered prior to its implementation. The crime must have been extremely egregious to warrant the ultimate penalty. An important point is that in cases of these serious, drastic crimes, there must be a death penalty because these murderers must be punished more severely than those who commit other types of crimes.
