name of Earl Lynd who had in 1988 killed his girlfriend (Gray, 2008). The reason for the delay in execution is because there had been a seven month hold on
capital punishment throughout the U.S. due to a Supreme Court decision (Gray, 2008). What was at issue in that Supreme Court decision is whether or not lethal injection is an
appropriate method of execution. Now that the case is resolved, there will be more executions from states that use the method. The state of Georgia has executed 39 individuals since
1976 ("Deadline: State by State Death Penalty Information : Georgia," 2008). In 1976, the case Gregg v. Georgia came about in response to an earlier decision, Furman v. Georgia (Shapiro,
1993). Furman was a reaction to the situation at the time where there were few guidelines in place to assure fairness; rather, there was arbitrariness in the system (Shapiro, 1993).
Shapiro (1993) explains: "After first rejecting the claim that the death penalty was under all circumstances a violation of the Constitution, the Court concluded that the Georgia statue before it
appeared to provide the protection necessary to permit the death penalty to be imposed. The court expressly left open the question of whether the statute was unconstitutional in its application"
(p.132). There had been 5 people exonerated on Death Row in this state, but there is no Innocence Project aligned with Georgia specifically ("Deadline: State by State Death Penalty Information
: Georgia," 2008). Still, the state is replete with cases that test the validity of the penalty and its fair application. In examining the death penalty in Georgia, according to
