functioning of any democracy. Discussion Probably the most important reason for guaranteeing the right to free speech is to allow people who disagree with the government to say so without
fear of reprisals. Many Americans throughout the centuries have disagreed with the policies enacted by the federal government, and they have felt it their duty to speak out against them.
If there were no free speech, or if speaking out meant arrest or detention, then there would be no effective way for opponents to make their views heard. Constitutional scholars
have all agreed that a democracy that does not have people questioning it and its functioning is not a democracy at all but a dictatorship. People absolutely must have the
right to protest the actions of government at every level, particularly when those actions affect them so deeply, as they often do. The Constitution doesnt limit free speech to actual
speech or print; it also protects actions. In Little Rock in 2008, a federal judge upheld the ruling of the 8th Circuit Court of Appeals, which found that the "Watson
Chapel School District (WCSD) violated the First Amendment rights of student when they disciplined them for wearing black armbands to protest the student apparel policy" ("Court cites landmark student free
speech case in finding district unlawfully suspended students for protesting school policy, 2008). Students, who had their parents help in planning the protest, were complaining that the "school apparel policy
was restrictive and unclear and was arbitrarily enforced" ("Court cites landmark student free speech case ...," 2008). The issue seems relatively minor, but the implication is important: not only did
