fact, it happens more often than many realize. In fact, "homicide is the second leading cause of death on the job" Scott, 1996, p.6). Yet, when murder is
committed, what is the liability of a firm that may be involved in the events? While OSHA has discovered that violence in the workplace is a safety hazard, new guidelines
may help but really do not answer questions pertinent to liability (1996). Some examples of when an employer is liable for murder may help to shed light on this compelling
subject. In Hunter v. State, a man was hired to work at a car wash ("Employer," 2002). Hood was on probation for statutory rape and he became acquainted with
a minor girl who also worked at the car wash (2002). Eventually, he would rape and kill his co-worker. While Hood did not engage in employer-related activity --the murder was
committed on his own time-- the lawsuit brought by the parents had been against the car wash as well as others (2002). The car wash would be found 40% liable
for damages and the man himself only 40% liable for the murder (2002). In other words, if employees are involved in a murder, the employer may be liable,
dependent on the circumstances. There are of course other ways that employers may be implicated for murder. In the past decade or so, there have in fact been murder charges
lodged against employers in cases where the death of workers, who were on the job, had been killed (Rosner, 2000). Fifty nine year old Stefan Golab for example inhaled
cyanide gas in 1983 while working at a film plant outside of Chicago (2000). The gas had been produced in the leaching process in the course of his employment
