However, although true in some respects, when it comes to urban planning and the gaining of planning permission there are some very different system with cultural as well as legal
differences. IF we compare a north European country with a south European country we see not only the difference in terms of procedures, but also the culture and expectations of
the system. If we consider the Netherlands and Italy there are two very different structure, both have strict laws, but the background to their development is very different. The
lack of enforcement and desire to avoid delays have lead to many developments simply ignoring or contravening planning permission in Italy, however, in the Netherlands, a stricter system of enforcement
has resulted in more controlled development. Despite this there are similarities, for example both countries use tight zoning legislation (De Bandt et al, 2001).
This can make the gaining of planning permission for commercial projects a more lengthy procedure, however, compared with countries where this does not occur it also avoids the possibility
of a similar project occurring nearby, giving a level of protection. If we wish to consider this in more detail then we
can look at the more hierarchical Netherlands system and policies of planning permission and urban development and then compare them with those in Italy. The Netherlands In the
Netherlands all administrational law has its basis in the legal certainty principle (Cullingworth, 1994). Therefore, the local land use plan; the bestemmingsplan, has the full force of the law (Cullingworth,
