This paper summarizes the first part of the book Fundamentals of Trial Techniques by Mauet and McCrimmon; the authors state that their subject is what, how and why the trial
advocate does what he does in the courtroom. Discussion Although there are other methods of resolving conflicts-and in fact, people are encouraged to use them because courts are backlogged-a traditional
trial is sometimes the only way to settle a dispute: "...pitting two adversaries against each other, with each presenting his or her version of the truth, is the best way
for the trier of fact to ascertain the probable truth" (Mauet and McCrimmon 1). Its also important to recognize that every jurisdiction, and sometimes every court, has different rules; the
person going to trial has to know what rules apply (Mauet and McCrimmon 2). One of the ways to remain organized and keep track of whats happening is to
prepare detailed file folders; the authors suggest that sections be labeled with clear categories such as "court records," "evidence" and "counsels documents" among others (Mauet and McCrimmon 3). This enables
the attorney working on the case to locate necessary documents immediately; it also means that others who work with him or her know where to go to find information.
The authors also consider what they call the "trial notebook," which is a means to organize "trial material" in the "most useful and effective way" (Mauet and McCrimmon 4). Among
the matters to be organized in the trial notebook are "facts, pleadings, discovery, motions, jury chart, witness chart, trial chart, exhibit chart" and so on (Mauet and McCrimmon 4). Also
included here are "examinations-in-chief, cross-examinations" and sections for closing arguments and research (Mauet and McCrimmon 5). Clearly, this book is written for someone who is not only beginning a law
