In 2001 and for the preceeding six years, Paula Cornish worked as a history teacher at Madison Country Day School, a private school
extending through the secondary grades. Madison Country Day School terminated her employment after her class engaged in a focused discussion of the American Civil Rights Movement, followed by students
independent collective decision to apply lessons learned in that classroom discussion. Plaintiff alleges that she lost her job at Madison Country Day School
not because of any failure to perform, but rather because she spoke against the Defendants decision to fire one of plaintiffs colleagues
II. INTRODUCTION Ms. Cornish maintains that her dismissal has resulted from an unwillingness on the part of the Trustees and Headmaster William Johnson
of the Madison Country Day School to address difficult issues. Ms. Cornish charges that her dismissal has not been based on quantitative and qualitative measures reflecting her students performance.
