is a case to be made. Saxton (1996) criticizes the legal system in the United States as being costly and inefficient in the administration of equitable awards. The tort system,
in contemporary America is one that has deteriorated due to perverse incentives which have led to escalating costs (Saxton, 1996). Due to the nature of the third party insurance system,
as well as its pain and suffering allowances, along with contingency fee litigation, perverse incentives and standards have in fact developed to increase the cost of the tort system (Saxton,
1996). In respect to auto insurance for example, these incentives have produced a situation that has much fraud and abuse within its midst (Saxton, 1996). The tort system has
generated both costly and unnecessary fraudulent medical claims (Saxton, 1996). Such problems result in a significant economic burden for everyone (Saxton, 1996). One study does demonstrate that tort costs are
up as well (Saxton, 1996). There is much argument for tort reform, but of course, there are two sides to every story. Tort reform does make sense because the system
is broken, encouraging people to sue anyone due to negligence or carelessness. The McDonalds coffee cup lawsuit is evidence that something is awry in the legal system. The case involved
an individual who drove through a McDonalds and ordered a cup of coffee. Unfortunately, upon taking the coffee cup, the consumer spilled the contents of the cup in her lap,
