liability when a person is injured after they leave work would seem to be the responsibility of the individual, not the employer. What if, though, the employer allowed the
employee to work an inappropriate number of shifts, and the employee left to tired to safely drive home? What if the employee was high school student, and restrictions were
set on the number of hours and the times of hours that a student employee should work. It is evident that these questions bring up a different view of
liability when accidents occur outside the workplace setting. There are two concepts to be considered when relative liability to issues in the workplace setting: the application of strict liability
and the issue of negligence. The assessment of these two concepts is valuable in evaluating the case of an automobile accident involving Matt, an 18 year old high school
student employed by Burger King (BK). Matts supervisor scheduled Matt to work a late night special clean-up shift on a week when he was already scheduled to work five
night shifts. Though BK usually scheduled regular workers, not students, for these late night clean-up shifts, Matt volunteered to take the extra shift when his supervisor was shorthanded.
After working more than one consecutive shift, Matt was tired, left work and lost control of his vehicle, causing injury to himself and one other person, and questions about liability
were raised. In the modern litigious American society, the concept of negligence is a central point in the development of tort law and determining liability for injuries or loss.
