the tasks performed and address, among other things, student academic progress and the skills and knowledge of instructional personnel, including, but not limited to, instructional methodology, classroom management, and subject
matter knowledge" (Code of Virginia, 2003). The fair practice and procedural safeguards put into place relative to the use of performance assessments and the impacts on hiring/firing practices relate
to the concept of due process and the application of due process in the evaluation of educator performance. Vacca and Bosher (2003) describe the criteria for evaluating teacher performance,
suggesting that veering from this criteria could be the basis for negative assessments of job performance resulting in firing. Educations should: 1. know the minimal standards of
performance; 2. know the criteria for evaluating educator performance; 3. receive prior notice of assessments of their performance; 4. receive immediate feed-back in based on the evaluations
conducted; and 5. be given an explanation of performance issues assessed and the areas they need to improve. If performance deficiencies are present, educators must also be given
an time line for the correction of these deficiencies and a date for a reassessment of their performance (Vacca and Bosher, 2003). This type of process is required in the
protection of both the governing body and the educators, but there must also be an outline of issues that would result in immediate termination of employment. The use of
