There seems to be a definitive philosophy that tends to protect the workers. This is something that evolved over time, changing the tide since the Triangle Factory Fire and other
detrimental events. In the United States, there are laws that guard against discriminatory practices and employers fear not being able to decide who to hire or fire. They do not
want to be accused of age discrimination or sexism. Of course, they do not want to get sued. Today, there are a myriad of laws that favor the employees and
workers rights. That said, the system is not perfect. There are of course drawbacks to this system. For example, while the system protects workers, it sometimes ties the hands of
employers, making them carry dead weight for fear of a lawsuit or simply not giving them free reign to make necessary decisions. Employment laws that have altered the definition of
"freelance" have prompted large companies to hire employees from temporary agencies, creating a new niche for firms, but hurting the freelancer and companies that used to benefit from the tax
saving strategy. While discrimination laws, and other laws that make sure employees have safe and suitable work environments are good, they are not strong enough. A new trend to
let go of older executives has swept America and while there are sporadic lawsuits, it has not stopped this trend. This has changed an entire generation. The up and coming
boomer has changed from the once revered hot shot to someone who is scanning items at grocery store checkouts. Many boomers are forced into early retirement. Other trends to emerge
from employment law have to do with seasonal workers, union workers and shops that block unions from forming. The black market is a large, lucrative one as are under the
