The Supreme Court is highest ranking court in the nation. It was established in order to oversee the judicial system
and to serve as a final determinant in the appeals process. Before a case ever reaches the Supreme Court it typically passes through several lower levels of judicial review.
Appeals to the Supreme Court are typically made on the basis of law, not fact. In other words, the factual circumstances of a case do not typically enter
into the scope of the Supreme Court appeals process. Instead, the Supreme Court bases its decision on the case on a determination of whether or not the law that
was in place concerning the case was applied correctly to the particular facts of the case. Meyer and Grant (2003) define
judicial review as "the power of appellate courts to review the decisions of government officials in the legislature, the executive branch, and lower courts" (470). Many throughout US history
have contended that judicial review is necessary in order to preserve limited government in this country. In the Federalist 78, for example, Alexander Hamilton argued that judicial review was
