Passed in 1995, the European Unions (EU) Database Directive came into effect on January 1, 1998. The US method of financial reporting appeared to be set to become
the world standard before the emergence of Enrons collapse and the growing number of stories of auditor scandal associated with it. Similarly, so does it appear that the EUs
Database Directive will become the guiding force on which other developed nations will base their own intellectual property laws regarding that type of electronic information.
The Database Directive has been discussed and analyzed in great detail over the past seven years, but as yet there has been no firm position established for the
sui generis right, that aspect of database construction and protection that applies to business needs and directly affects the competitive advantage that todays business environment obliges every organization to pursue.
