of implementing record-keeping rules and strategies. HHS works within the law. There are regulations such as EMTALA and HIPAA that impacts hospitals and medical facilities and the way that records
are kept. In fact, a number of laws affect the HHS Department, and some have come directly from the department itself ("Regulations," 2010). The Department of Health and Human Services
issues a number of regulations in order to implement the law ("Regulations," 2010). The organization further creates guidance for the health care industry as well as to develop appropriate
polices ("Regulations," 2010). The Department of Health and Human Services provides regulations for the industry as well as for state and local governments, and its rulings also impacts other related
organizations ("Regulations," 2010). HIPAA is a good example of that. The HIPAA rule provides federal protections for personal health information that allows patients a number of rights with respect to
information being kept ("Regulations," 2010). The Privacy Rule is balanced in a way that allows for the disclosure of personal health information that is necessary for patient care and other
important reasons ("Regulations," 2010). HIPAA is an important law, but it has its problems. New York Senator Chuck Schumer claims that the reason why pharmacies can sell personal information
has to do with a loophole in HIPAA ("HIPAA Loophole Allows Pharmacies To Sell Patient Data," 2007). It is something that is difficult to believe. Even before HIPAA there
had been the notion of privacy in terms of medical records, at least to an extent. HIPAA on balance does provide some protection for patient records. While The Department of
Health and Human Services does provide implementation of legislation and oversight, charlatans will find ways to circumvent it. HHS is supposed to step in when there are rule violations.
