Numerous legal steps have been taken over time to protect citizens from the exercise of arbitrary power. The most powerful of
these steps typically arise as a result of actions being challenged in court. An excellent example is the 1966 case of Miranda vs Arizona. There have been numerous
legal rulings over time that have had long lasting implications in terms of the way that arrests are made and suspects are interrogated. None, however, have had more importance
than Miranda vs Arizona. In that one critical ruling the face of the interview process as an investigative technique in law enforcement has been forever changed. Although the
Miranda vs Arizona ruling has subsequently been challenged a number of times, it has stood the test of time. The thesis can thus be presented that:
Miranda vs Arizona is not only one of the more long-standing but also one of the more critical
rulings in the protection of the people against the exercise of arbitrary power (maxim nemo tenetur seipsum accusare), that this ruling has resulted in a much needed tightening up of
standard law enforcement procedure particularly when it comes to arrest and interrogation. To demonstrate this
