more suspects are retained for trial. While no one wants a rapist or murderer on the loose, they do not feel that everyone in jail deserves to be there. Further,
when jails are overcrowded they may be deemed unsafe (Visser, 2003). To some extent, the unsafe conditions may be attributable to the fact that they have a certain capacity
and keep a certain amount of guards and so forth. When the jails become overcrowded, it could mean that both prisoners and guards lives are not protected as well as
they probably should be. In fact, in some facilities, there have been reports that frequent fighting among the prisoners and insufficient supervision are two very serious problems (Rohrig &
Atkinson, 2003). Not everyone in jail is necessarily a criminal and this is an important point. People are considered innocent until proven guilty and so, by not
addressing the overcrowding issue, states are putting the lives of innocent people at risk and making life very unpleasant to those waiting for trial. Prison overcrowding is a serious issue
as well, but prisons hold people who have already been sentenced and not just those who are waiting to stand trial. Further, judges who rule that jails are overcrowded create
a situation there the county or jurisdiction must act quickly. Overcrowding is quite a problem for many regions. While the American system of justice is rather fair, one only has
to look at the extremes of conditions in other countries to see what overcrowding can do. For instance, in El Salvador, inmates demand more space as well as a greater
