al-Qaddafi; the leader of the Libyan Arab Jamahiriya ho had been in power since taking power in a bloodless coup in 1969, along with two sons. The ones are Al-Mutasim-Billah al-Qaddafi the National Security Adviser of Libya since 2010 and Saif al-Islam Muammar al-Qaddafi. All are male Libyan nationals who face the charges of crimes of genocide, crimes against humanity and war crimes. These charges relate to events which have occurred in Libya since the 15th of February 2011. The situation in Libya saw increasing levels of social unrest between January and early February 2011 which became a full scale protest on the 15th of February 2011. On this date between 500 and 600 protesters calling for the resignation of Muammar al-Qaddafi1 gathered outside of the police headquarters in Benghazi. The demonstration was dispersed violently and resulted in 38 injuries2. Other incidences of violent breaking up of protests cited in the protection documents include 16th February 2011 with incidents at Misratah, Al-Bayda, Derna, Zenten, Ajdabiya, incidents on 18th February 2011 in Misratah and in Az-Zawiyah and Tripoli on 20th February 2011. The charges are brought against those who had de facto power over these events3. Reactions of the Libyan forces to the protests have included the indiscriminate aerial bombing of civilians by military aircraft. There were claims made on the 23rd of February that more than 200 were killed in one day alone in Tripoli and that the conflict had resulted in more than 2,000 deaths in Benghazi resulting from aircraft fire and heavy weapons use against protestors4.
