apply to all private sector employees, however, nor does it permit all sorts of actions on the behalf of the employee. There is, in fact, considerable room for the
NLRA to be amended to be more pro-union. The thesis can be presented, however, that:
It is doubtful that an amendment of the NLRA would result in a resuscitation of private unionism.
The likelihood of whether the amendment of the NLRA would revive private unionism certainly doesnt rest on the Acts shortcomings. Indeed, there is considerable room for
the amendment of the NLRA. In many ways, in fact, the Act is anti-union. Consider, for example, the number of employees that are excluded from its provisions. Specifically
excluded are airline and railroad employees when those employees fall under the Railways Labor Act (Fisher and Phillips LLP, 2007). Government employees are also excluded from the applicability of
the NLRA (Fisher and Phillips LLP, 2007). Interestingly, employees in the horse and dog racing industry, domestic servants, agricultural workers, independent
contractors and family members employed by their parents or spouse also fall outside the auspices of the Act (Fisher and Phillips LLP, 2007). While there are logical reasons for
some of these exclusions, some other exclusions can be blamed solely on the power of the particular lobby at the time the Act was drafted.
