many times over the history of our country. In most cases, of course, this most basic of American rights was upheld by the Courts. The right to free
speech, however, is precariously balanced with several other rights. When ones words cause harm, or even have the potential to cause harm, to another then the courts have to
decide just how far the right to free speech extends. This exercise was recently repeated in the case of Shawn Ee, 2008 NY Slip Op 01479. A juvenile,
Shawn Ee, was charged and found guilty of racial harassment because over the course of a two month period of time he had repeatedly called another student names and even
made subtle verbal threats against her. Shawn Ees negative interactions with the other student were not a one time event. Indeed these
interactions occurred over a two month period of time while the two were on a school bus either destined for their school or their respective homes. Shawn Ee called
the other student a variety of names during this period and some of these names were racially charged. In addition, Shawn Ee derided the student on the basis of
her gender and her color. He threatened the other student at one time saying "Ive got a gun with your name on it". In another threat he stated
"We shoot niggers like you in the woods". While these threats were entirely verbal in their nature, no physical interaction occurred between the two students, the school district took
