be compared to a living body, to an entity that takes it nourishment from its surroundings and develops into maturity on the basis of that nourishment. In theory, this
growth and development results in an optimization of law. Just as a living organism can experience setbacks in its growth and development, however, so can the law. Just
as a living organism can experience disease that impairs its function, so can the law. These are the realities of law. In the US our law has
developed around the basic premises covered by our Constitution. Our Constitution can be viewed as the backbone of our legal system. Just as living organisms (vertebrates at least)
have a backbone so too does law. Living organisms are also characterized by a bodies that are made up of specialized components. The liver, for example, specializes in
filtering our waste. Our brain specializes in coordinating all of the body parts and in our ability to think. Our hands specialize in reaching out and grasping objects.
Our laws are much the same. They are categorized into a variety of specialized areas. An excellent example lies in the laws that we have
that relate to due process. The laws relating to due process are specialized laws that direct how we deal with those that are believed to have committed a
crime. These laws have been put into place to assure that our rights as US citizens are protected even at the point where the system has essentially labeled us
as a criminal. Due process is, in fact, a cornerstone in individual rights. The history of due process and the protection
