aim of the directive is very applicable to the case study supplied by the student. This directive is to minimise and also prevent pollution of the air, water and soil
from emissions originating from agricultural or industrial facilities. The case study has a company that wants to set up an inefficient more
polluting facility as it is cheaper than using the latest technology. This will cost 50% less to run that the more up to date but will make 30% higher emissions.
This is a new set up and as such this directive applies. Had the operations been in existence already then the situation
would be the requirement of compliance by the year 2007 (Lexis, 2004). However, as this is a new start up there will need to be immediate compliance.
When we look at the way that this needs to be complied with all new business in any of the listed activities. Under these regulations
where there is the need for a licence the operator has to apply for a permit (Envionwise, 2004). These are given out by the relevant regulatory bodies in each country.
The approach is different in each country due to the principle of subsidiary. These may be national environmental agencies or local authorities depending on the level of the activities (Envionwise,
2004). Where an application is made this needs to include a full assessment of the potential impacts that will take place as a
result of the activities. There is the requirement that within the activities there should be the use of Best Available Technology to reduce the emissions.
