the EU has been the concept of free movement of labour, with employees able to move freely throughout the countries within the EU in order to undertake employment. In the
Treaty of Rome, the foundation of the modern EU, signed in 19571, established the European Economic Community, EEC, and article 48 stated that "freedom of movement for workers shall be
secured within the Community by the end of the transitional period at the latest" (Weatherhill and Beaumont, 2007). Furthermore freedom of movement of workersm which is part the free
market concept is seen under Article 39, for the self employed there is a separate article, article 43 and we can also look at article 49 that gives companies and
individuals the right to provide services across boarders, so that workers or companies do not have to reside in the state they are supplying (Dyrberg , 2003, Weatherhill and Beaumont,
2007). The free movement of labour has been backed by anti-discrimination laws, this means that there are increasing pressures on organization to ensure that the measures out in place do
not discriminate against EU employees, at article 39 (20), where it sates that there cannot be "discrimination based on nationality between workers of members states regards employment, remuneration and other
conditions of work and employment" (Lexis, 2009). This article also has direct effect and builds on Article 12 (Weatherill and Beaumont, 2007). However the impact has been minimal, as threw
