Von Huben 8/2010 Please Introduction Generally speaking, people strongly dislike it when third parties have access to their medical records, particularly when they have idea that such access has been granted. HIPAA was passed to insure that these sensitive records remain secure. This paper considers the impact HIPAA has on human services, by which is meant not only the Department of Health and Human Services, which is tasked with administering the provisions of HIPAA, but also those other agencies that are responsible for maintaining the security of medical records. Discussion The Health Insurance Portability and Accountability Act of 1996 (HIPAA) was created to establish guidelines for handling sensitive medical information. Within HIPAA is the "Standards for Privacy of Individually Identifiable Health Information," referred to as the "Privacy Rule"; it is a "set of national standards for the protection of certain health information," the first time such legislation has been enacted (Summary of HIPAA privacy rule). The Privacy Rule was issued by the Department of Health and Human Services (HHS) in order to implement the HIPAA requirements for confidentiality in medical records (Summary of HIPAA privacy rule). The standards established by the Privacy Rule cover the "use and disclosure of individuals health information" by those organizations subject to HHS regulation; they also cover an individuals rights with regard to understanding and controlling how this information is used (Summary of HIPAA privacy rule).
