of this policy. THE SOCIAL POLICY The United States lays claim to having the worlds highest incarceration rate as a direct result of federal minimum sentencing requirements mandated by
law in the 1980s. The result is that state correctional prison budgets are exploding and the national inmate population currently stands at one million prisoners (Grayson, 1997). Californias
courts are torn between liberals who push for rehabilitation and conservatives who call for punitive measures in the treatment of prisoners. Courts are obliged to administer criminal justice yet
are duty-bound to uphold the Constitutions recognition of the rights of inmates. To settle this conflict, courts must prescribe the basic constitutional requirements in correctional management which prison officers should
adhere to (Pollack, 1996). Because domestic violence and crime have been directly related to drug use, one state decided to institute a social policy that would help serve to reduce
these appalling statistics. With its "three strike and youre out" program, the West Coast state has demonstrated its firm stance on the issue of illegal drugs. At the
helm of this controversial topic is the mandate of minimum drug sentencing for what some consider to be insignificant usage. As such, people caught with what would have one
time been considered a negligible amount of cocaine are now - under new and forceful laws - looking at a mandatory minimal jail sentence. "Those who commit crimes should
be punished. And those who commit repeated, violent crimes should be told, When you commit a third violent crime, you will be put away, and put away for good.
