Intellectual Property Rights - new drugs can be patented for up to 20 years. This gives manufacturers exclusive marketing rights throughout that period at a price set by them1." However,
under certain circumstances, such as a national emergency, TRIPS does allow signatory states to pass national laws so that they may bypass patents and produce or import cheaper versions
of any patented drug2. Despite this provision, TRIPS seems to hinder developing states. Also, this problem is just the tip of the iceberg as it respects problems TRIPS causes.
Before exploring the problems TRIPS truly presents for the pharmaceutical industry, it pays to look at the World Trade Organization, TRIPS, and how the legislation came about. First, the World
Trade Organization, or WTO, is the organization that deals with rules of trade that exist between nations3. There are, since 2005, 148 nations that are a part of the
WTO4. There are eighteen agreements with which these member countries adhere, and they cannot eliminate one or another to their liking5. Hence, nations cannot decade not to abide by
TRIPS for example. In any event, the TRIPS Agreement is thought to be something that will have its most significant impact on the pharmaceutical sector, and it will affect access
the medications6. What is the TRIPS agreement and how long has it been in effect? TRIPS began in 1995 and is thought to be the most significant multilateral agreement as
