Although the European Court has a number of different roles, its function is based on several basic premises with regard to the way in which the EU
itself is structured, and the importance of legislation in terms of maintaining the unity of the European Community. For example, unlike previous initiatives designed to achieve unity in Europe, the
EU relies on the rule of law to a much greater extent than was previously the case.
From the inception of the Community, the six member states which founded it were aware that successful
unification would depend on the maintenance of the rule of law. Consequently, the EC was derived through the legal instruments of the Treaties of Paris and of Rome, and the
objectives of the Community are enacted through the law of the EC. In this sense, it could be asserted that the ECJ provides the backbone of the EUs policies, in
the sense that its aims and objectives are clarified and supported through the rulings of the Court.
Community law is independent of the domestic laws of the individual member states and supersedes
them; it is consistent across the Community and in many cases its provisions can be directly applied in all the member states. The judicial safeguards which must be utilised in
order to ensure that Community law is applied effectively are provided by the ECJ.
