Compromise was unconstitutional (McWhirter PG). What happened in the case was that Dred Scott, who was a slave, had been found in the portion of the Louisiana Territory that
the Missouri Compromise declared to be free (PG). However, when he went back to Missouri, Scott sued to be free there, arguing that because he had been living inside free
territory at the time, that he had in fact become free (PG). It is quite puzzling when such jurisdictional issues crop up. British law does hold in favor of Scotts
claim (PG). However, the U.S. Constitution did not support Scotts assumption. It was a complicated issue for the Supreme Court. There were eight different opinions which surfaced, but the opinion
of Chief Justice Taney is thought to be the opinion of the Court (McWhirter PG). Taney essentially ruled that the Missouri Compromise was unconstitutional and went on to say
that black people were inherently inferior, and that the federal government and the states did not have the power to change the status of a former slave, and also that
Congress did not have the power to grant citizenship to former slaves (PG). He suggested that this opinion was in congruence with the nations Constitution (PG). According to the decision,
even if the federal government could buy the slaves, the freed slaves could not be turned into citizens without an amendment to the Constitution (PG). Because half the states
of the union were slave states at the time, passage of such an amendment would have been impossible (PG). Dred Scott left the nation with only one way
