where people are generally vehemently opposed or vehemently for the idea. Those who support same sex marriage are generally gay rights activists who firmly believe that same sex partners should
have the same legal and economic protection that do heterosexual couples. The opposing view contends that same sex marriage is ridiculous. It is unnatural. Further, allowing it is tantamount to
endorsing a deviant lifestyle. There are many points regarding same sex marriage that should be discussed, one of which goes to the will of the people and the Constitution.
George Bush recently requested that same sex marriage be outlawed by a constitutional amendment. This outraged supporters of the concept but was a comfort to some traditionalists who really oppose
gay marriage. Still, to others, Constitutional amendments should be reserved for broader concepts and used sparingly. Although they oppose gay marriage, they also oppose an amendment. The first point is
that Constitutional amendment or not, most people do not support same sex marriage. It is however a point of contention. Martin (2004) says that people do want same sex marriage.
He claims: " This democratic legitimacy does not exist when a court uses a constitutional provision to strike down laws in a manner inconsistent with the intentions of the people
in enacting that provision. Yet that is precisely what has happened in the SJCs rulings on same-sex marriage" (p.25). But a survey by News & World Report reveals that when
asked whether same-sex marriage should be recognized by the law, 64% ("Should," 2004, p.28) of respondents said no. It does appear that the public by and large is opposed
to the concept. Another point is that marriage is really only an institution because children are a product of marriage. It is designed to protect children and it was
