notion implies that law is a species of moral realism and that there is an objective set of rules or principles which dictate proper conduct (McLeish,1993). Not killing another human
being is perhaps a basic natural law as humans just know intrinsically that they should not kill. While some lower animal forms might kill, mans ability to reason should set
him apart from other beasts and thus, logic should prevail. Killing another human being is against natural law, biblical law and judicial law. The death penalty then is technically a
form of murder and against human nature. Aside from the philosophical arguments there are those that take practical matters into consideration, suggesting that it is for the greater good that
a potential repeat offender is executed or that it is for the sake of deterrence or retribution. Another interesting stance is that the death penalty is inherently unfair in the
way it is presented in society. Along with Marxs notion that class conflict defines society comes proof. In America today, there is not only a class war, there is a
racial war. The two are essentially inextricable in 1990s America. The reason why the two are linked, to an extent, is because minorities tend to be on the lower rungs
of a stratified society and so are economically disadvantaged. Statistics bear out that there are proportionately more minorities on death row. Further, sociological theory, from a conflict perspective, proves that
a fair administration of capital punishment in the United States is simply not possible. A black person cannot get a fair trial in America. How can he expect to receive
