The American legal system revolves around two primary players when it comes to criminal sentencing. These players are the judge that
presides over the case and the jury that is assigned to weigh out the evidence. The criminal trial process, from jury selection to sentencing, incorporates a number of specific
steps. In the criminal justice process the defendant is given the option of plea bargaining or entering a sentence of not guilty
and having the court weigh his or her innocence or guilt. The verdict is rendered dependent on factors such as jury and judge personality and sometimes even specific guidelines
for the particular type of crime. Not surprisingly, an estimated ninety-five percent of criminal convictions occur through the plea bargaining process (Watkins, 2004). Plea bargaining is a
process of negotiation in which the prosecuting attorney offers a defendant a lesser charge or a lesser degree of punishment than he or she might receive if tried and convicted
for their crime. It is important to emphasize when considering the plea bargaining process that, as Bar-Gill and Ben-Shahar (2010) observe, plea bargains
