the models contains different goals. The crime control model has the goal of serving the community by controlling crime (Samaha, 2005). The due process model serves to guarantee the rights of citizens (Samaha, 2005). Packer associates the Crime Control model to an assembly line (Laufer & Adler, 1987). He then claims that the Due Process model is like an obstacle course (Laufer & Adler, 1987). Clearly, both models are important in the scheme of things. While crime control is important, it is also important to preserve the rights of the people. The idea of due process and crime control are concepts that have always been at odds (Samaha, 2005). This is a reasonable conclusion. After all, the goals of each system are very different. Defendants need to have due process in order for the state to provide fairness in terms of legal matters. Everyone realizes that without Miranda, and without the fourth amendment, and so forth, the police would take advantage when they arrest a suspect. Protections must be implemented so that there is a sense of justice. Due process means that there is fairness inherent in the investigation of crime. For example, people should not be detained without substantial evidence. Of course, while due process is a given, some see murderers getting away with their deeds because of it. For example, the recent case of Florida involving Casey Anthony sees a suspect where evidence is overwhelming. Yet, the police had been very cautious in pointing fingers because unless everything is done above reproach, there is a chance that Casey will be let go on a technicality.
