the artists who contributed to the display, used natural substances to create his works and for one, he used elephant dung ("Art on Trial," 2006). It was not the use
of the objectionable substance that really caused a stir but the fact that he used the dung to create a portrait of the Virgin Mary ("Art on Trial," 2006). This
rattled the sensibilities of a religious public. A great many people in New York are Catholic and the Virgin Mary is sacred. When the same show appeared in London, a
similar reaction occurred, not only to Ofills work but to several of the pieces ("Art on Trial," 2006). Interestingly, Sensation did not rely on public money ("Art on Trial," 2006).
Still, Mayor Giuliani decided to withhold funds for the museum that chose to house the exhibit ("Art on Trial," 2006). Giuliani decided to throw the exhibit out as well and
this prompted a lawsuit ("Art on Trial," 2006). In the case Brooklyn Institute of Arts and Sciences v. City of New York, the federal district court would put up a
preliminary injunction ("Art on Trial," 2006). This would prevent, at least temporarily, the City from taking action against the museum ("Art on Trial," 2006). The Court would
also issue the injunction as it believed that, after the case would be fully litigated, it was more likely than not that the Citys proposals were in retaliation for the
exhibit ("Art on Trial," 2006). That would be construed as being unconstitutional ("Art on Trial," 2006). It is true that the first amendment does protect artists
