just perhaps a matter of course centuries ago, to put to death those who broke the law in horrific ways, or even not so horrific ways, in the past few decades it is often seen as immoral, unethical, and simply an act of an unenlightened and barbaric nation. But, there is also the question of whether or not capital punishment is even constitutional. In the history, even relatively recent history, of the nation there has never been a question of whether or not capital punishment was constitutional for it was all but the law of the land. Bug, in more recent times methods of putting people to death have come under scrutiny concerning the constitutionality of the process or procedure used. With these conditions and realities in mind the following paper examines the capital punishment, the death penalty, and its constitutionality. The Constitutionality of Capital Punishment First and foremost it is perhaps important to understand any controversies of late that involve the constitutionality of capital punishment and what they actually entail. The questions or controversies of late have not really involved whether or not the death penalty is constitutional but whether particular methods are constitutional. However, prior to examining processes which may or may not be constitutional one must look at the Constitution itself and what the focus is all about. When speaking of the Constitution itself it seems that two particular amendments come under scrutiny when it comes to the death penalty. Those amendments are the 8th and the 14th.
