One of the more important of those factors, however, has been the US Constitution itself. The U.S. Constitution is often regarded as an all-encompassing document that is designed to protect the rights for American citizens. In the U.S. our law has developed around the basic premises covered by our Constitution. Consequently, our Constitution can be viewed as the backbone of our legal system. The Constitution not only provides for individual rights, it also dictates how laws can be formed and enforced and by whom. The concern for individual rights is something that can be traced much further back in history than the establishment of the US itself. The US Constitution, however, is considered the most superior example in the world of how human rights should be protected. One of the primary means through which it provides this protection is through due process. The laws relating to due process are specialized laws that direct how we deal with those that are believed to have committed a crime. These laws have been put into place to assure that our rights as US citizens are protected even at the point where the system has essentially labeled us as a criminal. Due process is, in fact, a cornerstone in individual rights. The history of due process and the protection it afforded American citizens can be traced back to the Fifth Amendment of the U.S. Constitution, an amendment which states in part that we shall not be deprived of our life, our liberty, or our property, without due process of law.
