Canadian Supreme Court described the rule of law as the "source and fabric of all social organization," providing a "framework for relations among individuals as well as between the individual
and the state" (Sharpe, 2000, p. 202). He tied the rule of law to each individuals liberties and responsibilities as well as to the powers and duties of government, calling
this the highest guarantee of equality. However, laws written to protect the good of society often come into conflict with individual rights.
Trying to keep a balance is a complex matter requiring governments to rely on a democratic system of checks and balances to serve both the public good and ensure individual
rights. Most of the time, this balance is decided in the courts. As a rule, the justice system provides the best forum for providing balance. There are other ways to
extend individual rights. Analysis A balanced government offers a balance of powers between the legislative,
judicial and executive branches, and in this case, the balance is struck in the courts. Sometimes, however, once laws are passed, the courts cannot always be the only option. Some
options include appealing to the executive branch and working with others through collective actions. There are often good reasons why laws should not or cannot be reversed. When this happens,
collective actions seeking individual rights often work better than other alternatives. For example, many U.S. citizens feel the balance between public good and
individual rights has been lost since the terrorist attacks on September 11, 2001. The Patriot Act was passed giving government agencies greater surveillance powers and exclusions under the Freedom of
