often run things, in particular that which involved the British rule searching peoples homes and even seizing things without any cause. As such the 4th Amendment was put into the
Constitution to protect people. Sometimes, however, this particular right is violated. The following paper examines the doctrine associated with the 4th Amendment known as the Fruit of the Poisonous Tree
doctrine. The 4th Amendment and the Fruit of the Poisonous Tree As mentioned, the 4th Amendment protects people against any unreasonable
search and seizure. This means that unless there is a reason to believe a crime was committed officials have no right to enter someones home, or any private place, and
search for items, much less seize those items. "the police have probable cause to believe they can find evidence that you committed a crime, and a judge issues a search
warrant, or the particular circumstances justify the search without a warrant first being issued" (Nolo). But, sometimes this does happen and this will often lead to the Exclusionary Clause. In
this clause it is stated that if an unreasonable search was conducted nothing found in the search can be used in a court of law for the evidence becomes invalid
(LaMance). In turn this will often lead to the Fruit of the Poisonous Tree doctrine. The Exclusionary Clause was first seen as necessary in 1961 (Nolo).
It was in 1963 that the need for the Fruit of the Poisonous Tree doctrine became necessary: "[T]he fruit of the poisonous tree doctrine...is drawn
