be illegal? This is the thesis question in this paper that will be addressed through statistical data, testimony and other empirical evidence. One rainy morning on the
way to work Tom called his wife on the cell phone, still agitated over the argument they had had the night before. His wife, who was angered that he
would continue an argument that she felt had been foolish in the first place, proceeded to shout right back at him over the phone. Suddenly she heard a crash
and the phone went dead. Tom, in his fit of rage while talking on the cell phone, failed to see the driver ahead of him slam on the breaks.
Skidding on the wet road, Tom plowed into the compact car in front of him and was pronounced dead at the scene. The driver of the compact car
was also killed, having crashed into the car in front of due to the force of the impact of Toms car. Who is at fault here? Tom, certainly, should
have been paying attention to his driving rather than talking on his cell phone. The driver of the compact car was judged not at fault since he had braked
in plenty of time to avoid the slowdown in front of him. What about Toms wife, who knew Tom was using his cell phone while driving on rain-soaked roads
