Over the past few decades, however, and in the wake of the more recent terrorist events, individual privacy rights and the right of the individual to private information has come under close scrutiny. This has left lawmakers wondering at the exact definition of personal rights and personal privacy on both the federal, state, and local levels. Unions in the workplace have made the practice of using hidden cameras more difficult for the employer but it has not reduced it entirely. The use of the hidden camera is nothing new, but the context in which they are being utilized is a source of great debate(Sableman 2004). Hidden cameras were the stock and trade of investigative journalists for decades, were even the stuff that spies were made of. However, now the use of hidden cameras, whether hidden in the workspace or mounted clandestinely on another undercover employee has civil liberties unions and many workers claiming that the right to privacy has been breached. And they may very well have every right to make such statements. At what point is privacy sacrificed for the sake of security? This is a question that the federal government has come up against in the wake of arrests stemming from the September 2001 bombings. Interestingly enough, this idea of a persons right to privacy was already tried and decided as early as 1967 with a court case called the Katz v United States. A quick summary of the case shows that police arrested and incarcerated a Mr. Katz after obtaining incriminating evidence against him while he transmitted wagering information by phone across state lines.
