understand tangible and intangible property and intellectual rights. An understanding of these rights and concepts can help the pharmaceutical company mitigate any risks arising from intellectual and property concepts.
Many people gripe about "Big Pharma" and the prices charged for various drugs and prescriptions. Others are somewhat confused as to why a particular
drug may not be available in "generic" form as yet. A lot of this has to do with patents and intellectual property rights.
Two issues affecting the pharmaceutical industry pertaining to intellectual property rights are patent protection for formulas and trademark registration. Intellectual property
involves exclusive rights granted by the State over creations from the human mind; these can include inventions, artistic works, signs and designs used for business - and in the case
of medicines, drug formulas (Intellectual property rights for SMEs in the pharmaceutical industry, 2010). One thing we know and understand about the
pharmaceutical industry is that its extraordinarily research-intensive, especially in the United States (Mossinghoff and Bombelles, 1996). It can take years for a drug to move from concept to marketplace, and
in between those two endpoints are research trials, approval processes and other activities. By the time the drug makes it to market, a pharmaceutical company has spent upwards of millions
