to kill Mr. McConkey, an ensuing infection resulted in his death. Mr. Thornton was convicted of the crime of murder in the first degree and filed an appeal to
have the conviction reduced to voluntary manslaughter. History Mr. Thornton and his wife were separated and his wife had repeatedly told him that she believed the
marriage to be over and that she was considering dating other people. Mr. Thornton hoped to continue to pursue a marriage counselor in the hopes of reconciliation. After
an evening out with his family (wife and child), Mr. Thornton returned them to their home and left to study in his apartment. He called a number of friends,
one of whom told him that his wife did not believe that his desire for reconciliation was earnest and Mr. Thornton decided to return to Mrs. Thorntons home to address
the issue. Upon arriving at her home, Mr. Thornton saw Mrs. Thornton visiting with a man. He spent a considerable amount of time watching from outside the
home, before returning to his apartment to get a camera and a pistol. Mr. Thornton returned to Mrs. Thorntons home and watched form outside, taking pictures that he claimed
were to be used in their meetings with the marriage counselor. After some time, Mrs. Thornton and Mr. McConkey began to have sexual relations and Mr. Thornton broke into
the room, confronting the naked couple. It is at this time that Mr. Thornton shot Mr. McConkey in the hip. Mr. Thornton then telephoned 911, directed an ambulance
