does not take into consideration the disruption these students can cause in the classroom, on the playground, or even in the cafeteria. The laws today still seem to reflect the
situation as it existed prior to IDEA (and EHA before that). One of the purposes of the initial law was to assure that special education children were not simply suspended
or expelled for conduct problems (Wrights Law, 2009). But, PL 94-142 was adopted more than thirty years ago. Still, legislator are treating school personnel as though they have not learned
anything in those years. It is true that the 1997 reauthorization seemed to recognize that school personnel needed more flexibility when disciplining students with conduct problems (Wrights Law, 2009). They
finally recognized there was a safety risk posed to everyone else in school (Wrights Law, 2009). They discussed the importance of special education students adhering to school rules and they
allowed the school to remove students who violated the code of conduct for the school (Wrights Law, 2009). Even with these amendments, the law suggests that all personnel
should have behavioral intervention knowledge and skills to diminish or at least mitigate behavior problems (Wrights Law, 2009). The school is supposed to provide staff development activities that train teachers
in these interventions (Wrights Law, 2009). But what if those interventions do not work? One option is to include the behavior issues in the IEP (Wrights Law, 2009). This would
allow the team to identify which interventions would be used and by whom (Wrights Law, 2009). Using the IEP process is appropriate when the childs behavior interferes with their ability
