all public placed in California the debate regarding smoking on campus has come to the fore (Delicio, 2001). The arguments over freedom of choice and liberty of smokers are
balanced against those of the non smokers who argue they should not be forced into passive smoking (Delicio, 2001). In numerous other public places, such as restaurants and theatres, smoking
bans have been put into place by the establishment owners. The responses from colleges to this problem have been mixed. Some have banned smoking completely whereas other are seeking to
control the areas were smoking takes place. Riverside Community College has instigated a ban on smoking on Campus which has been in effect since the 1st of January 2003.
The ban has incorporated education as well as sanctions, college President Salvatore Rotella stated "Its going to be more of an educational effort than anything else... There are sanctions, but
they are a last resort. The emphasis is on education." (Backersfield.com, 2002). The move has not been universally welcomed, it has been reported that the teachers are considering their position
and may file an un-fair labor practices claim as a result of this smoking ban, Dwight Lomayesva, president of the California Teachers Association chapter at the collage argues that the
teacher should have been consulted with the ban equating to a change in the working conditions which was not agreed though collective bargaining (Backersfield.com, 2002). Riverside is not the
only campus to ban smoking, in 194 University of California at Los Angeles placed a ban on smoking in all areas with the exception of the dormitory rooms, but even
