dramatically over the last ten years. As the view that smoking is a voluntarily assumed health risk has declined, the political and social environment has become increasingly more conducive to
governmental regulations on the tobacco industry. The change in public and political opinions are directly related to continuing evidence that: secondary smoke creates health risks to innocent bystanders; nicotine is
addictive; young people are being exploited by the tobacco industry; and that the tobacco industry is fully aware of the harmful effects of tobacco. Political and legislative actions taken
against the tobacco industry has raised a number of concerns relating to constitutional protection for free speech in terms of advertising. They have in fact raised questions regarding the constitutional
rights of individuals to smoke without being harassed. Political, Legislative and Social Issues One of the most controversial public policy topics at all levels of government
today is the use and regulation of tobacco. The dilemma is how a product that causes serious health problems when used as intended can be regulated when it is legal
for people over the age of 18 to purchase and use it. The political concerns relate one simple question: under what circumstances can the government limit individual freedoms in order
