tradition that the English brought with them to the North America. Therefore, the rights for which American colonials fought for were not "new freedoms," but rather they fought "to preserve
liberties that dated at the 13th century" (The Magna Carta, 2011). Therefore, when independence was won and the task of formulating a new government was upon them, America turned
to the English common law traditions, which derived from the Magna Carta. This heritage is especially apparent in the Bill of Rights, as the Fifth Amendment, which specifies that "No
person shall... be deprived of life, liberty, or property without due process of law" is quite similar to the Magna Carta, which declares, "No freeman shall be taken, imprisoned,...except by
the lawful judgment of his peers, or by the law of the land" (The Magna Carta, 2011). Mayflower Compact (1620): The Mayflower Compact, which was signed on November 11,
1620, can be considered the first constitution drawn up in America, as it attempted to establish a temporary government in order to address "mutinous speeches," which were being made in
regards to the location chosen to establish the Plymouth colony (Mayflower, 2011). The precise influence of the Mayflower Compact on the U.S. Constitution is unknown, but John Quincy Adams, a
descendant of a Mayflower passenger, referred to it as the "foundation of the U.S. Constitution in a speech given in 1802" (Mayflower, 2011). Declaration of Independence (1776): This historical
document consists of five sections. In its preamble, Thomas Jefferson stipulates the "principles that were already recognized to be "self-evident by most 18th-century Englishmen" (The Declaration, 2011). These same principles
