due to obesity weight gain is an important issue. Numerous studies have indicated that increased weight gain is associated with the practice of eating in restaurants. In one study Purdue
University along with the U.S. Department of Agriculture studied 16,000 adults, with a statistical difference found between those who ate out in restaurants regularly and those who did not (Environmental
Nutrition, 2001). This study appeared to indicate that fast food outlets presented the greatest risk of weight gain (Environmental Nutrition, 2001). In a second study pre menopausal
women were studied by the University of Tennessee. In this is was found that subjects that eat in restaurants more than five times a week consumer nearly 300 additional calories
each day (Environmental Nutrition, 2001). Arguments exist both ways, the decision to eat out is a personal decision and the effect is not
singular but one of accumulative effect. For many it is deemed that the weight gain is simply a part of the couch potato lifestyle (Greenblatt, 2003). These are not aspects
for which a restaurant can be held responsible and it can also be held liable that in any action the plaintiff also has a responsibility to use common sense, which
