Whittaker, 2006). The American Nurses Association (ANA) defines a "technician" as a "skilled workers who has specialized training or education within a specific area" (ANA, 1997). The term "Unlicensed
Assistive Personnel" (UAP) is defined as an individual "who is trained to function in an assistive role to a licensed registered nurse" and the definition mentions that this term can
also refer to "technicians" (ANA, 1997). As this indicates terminology is vague and can change from state-to-state. Therefore, to simplify this discussion, the term UAP will be used and should
be understood to encompass surgical or "scrub" technicians. Incursion into nursing practice by non-nurses is occurring throughout the US, according to Nancy Agard, RN and associate director of Nursing
Practice and Services for the New York State Nurses Association (NYSNA) (Bruser and Whittaker, 2006). A key issue in this debate is the scope of practice, which is legally defined
for RNs according to the state nurse practice law in their state. Such statutes define, through scope of practice, the activities that "only a nurse can perform" (Bruser and Whittaker,
2006). The activities of UAPs, unlike those of nurses and other licensed caregivers, is defined through job description and not regulated through scopes of practice (Bruser and Whittaker, 2006). When
