The purpose here is to summarize articles addressing each topic. School Choice The first shoe to drop was the passage of No Child Left Behind (NCLB) in 2002. The other came crashing down on some of the countrys school systems receiving Title I funds after the third full year of operation under NCLB. Birmingham, Alabama schools have failed to meet the testing standards required by NCLB, and the U.S. Department of Education ordered the district "to allow students from a dozen low-performing middle schools to transfer to other schools" (Robelen, 2006; p. 7) as required by law. This was not an automatic order triggered by testing results, but rather the result of a challenge by Birmingham-based advocacy group Citizens for Better Schools. The Department of Education already has set precedent for "bending" the rules of NCLB, not for the purpose of subverting the spirit of the law but as a means of promoting achievement while also preserving federal funds received by school districts under Title I rules. That "bending" occurred in Virginia, where the Department of Education gave permission to four districts "Virginia to effectively reverse the order of the NCLB sanctions and offer tutoring in the second year and transfers in the third" (Robelen, 2006; p. 7).
