Dred Scott case, The Missouri Compromise, The Civil War Amendments, The Civil Rights Cases of 1883, and the landmark case of Plessy v Ferguson, would be several of many such inflammatory issues which would rise time and time again, pitting American citizen against American citizen until the inevitable seemed likely: War. Dredd Scott v. Sanford Dred Scott was the name of a slave who in the 1850s sued to prove that he was a citizen of the United States(Weisbrot 1). This was unheard of at the time and as such made headlines. After much debate over the issue, an issue which further divided North from South, the Supreme Court declared that African Americans were not U.S. Citizens. In one fell swoop, the same court reversed the previous Missouri Compromise which banned slavery in the territories north and west of the state of Missouri, declaring the Missouri compromise to be unconstitutional. This landmark case would be one of several civil trials which would publicly illustrate the ongoing struggle between the ideologies of the North and the South. The Chief Justice at the time was Roger Brooke Taney and as the spokesman for the Supreme Court stated that blacks, even if they were freed blacks, were not due citizenship and could never become citizens of the United States. As such, then, Dred Scott, nor any other person of color had the right to sue for freedom or any other right in a US court of law(**).
