Giltman 5/2010 Please The Sixth Amendment to the United States Constitution establishes rights individuals have when it comes to criminal prosecutions. This amendment states that the accused parties have a right to a speedy and public trial, an impartial jury, a list of accusations as to why they are being held by the court, and a right to counsel. Basically, having the right to counsel means a defendant can be represented by an attorney of his or her choice or the accused can decide to represent him or herself in a court of law. However, it should be noted that if the court deems the defendant incompetent due to illiteracy, ignorance, or possible feeble mindedness, then the judge may waive the defendants right to represent himself if the court feels he or she may be unable to do so in a proper manner. In addition, if a defendant is indignant and does not have the financial means to hire an attorney then one will be appointed to the accused.
