a young woman, Sarah Tobias (Jodie Foster), who is gang-raped by three men in the back room of a bar, while a whole crowd of other men stand around and
cheer the rapists on. The film concerns Sallys fight for justice, and how the U.S. criminal justice system is skewed to favor those with money and influence. The first thing
of importance is the fact that Tobias is not a particularly likable character. Shes an alcoholic, she smokes pot and occasionally uses harder drugs; she lives with a drug dealer
and dresses provocatively. When shes raped, no one is sympathetic to her: not the nurses and doctors who examine her, not the police, and certainly not the prosecutor Kathryn Murphy
(Kelly McGillis) who takes her case. There seems to be an unspoken "rule" in effect here: that because Tobias is sleazy and a drunk, she was "asking for it" or
"deserved it." The District Attorney tells the prosecutor to make a plea bargain and she does - she gets the rapists to plead to the lesser charge of "aggravated assault",
and while they do go to prison, the word "rape" is not used and they are not found guilty of a sexual crime (Ebert, 1988). As Ebert says in his
review, "`The Accused demonstrates that rape victims often are suspects in their own cases. ... Is their personal life clean and tidy? Or are they sluts who were just asking
for it?" (1988). He continues that he knows the sentence is brutal, but "the words were carefully chosen, because sometimes they reflect the unspoken suspicions of officials in the largely
male judicial system" (Ebert, 1988). That is the point of the film: this woman is the victim of a brutal rape, but her attackers are not identified as rapists, only
